These Terms of Service (“Terms”) govern your access to and use of Ecoyaan.com and the Ecoyaan mobile app (together, the “Platform”). The Platform is owned and operated by Kindkarma E-Retail Private Limited (“Ecoyaan”, “we”, “our”, “us”).

By accessing or using the Platform, you agree to be bound by these Terms and our referenced policies. If you do not agree, please do not use the Platform.
You must be 18 years or older to use the Platform. By using the Platform, you represent and warrant that you are at least 18 and that the information you provide is true and accurate.
Ecoyaan operates a curated online marketplace and acts as an intermediary under Indian law. We connect eco-conscious buyers with verified sustainable sellers. Contracts of sale are directly between you (the buyer) and the seller ; the seller is the merchant of record . for such transactions. We facilitate discovery, payment processing, customer support and logistics coordination where applicable.
We require sellers to make truthful sustainability and health/safety claims (e.g., vegan, organic, cruelty-free, plastic-free, biodegradable) and to provide supporting documents/certifications on request. We may use internal tools (including Ecoverify™) and human review to assess claims. We may remove badges, delist products , or suspend sellers in cases of suspected misrepresentation or greenwashing.
Sellers are responsible for product descriptions, images, certifications, pricing, taxes and stock. Despite best efforts, content may contain errors or be out of date. We reserve the right to correct errors, update information, or cancel orders (with full refund where applicable) due to inaccuracies, stock issues, or system errors.
All orders placed via the Platform are offers to purchase. Acceptance occurs when (a) the seller or Ecoyaan (acting on seller’s behalf) confirms dispatch, or (b) the order status indicates acceptance under our process. We may refuse or cancel any order for legitimate reasons, including unavailability, pricing/data errors, suspected fraud/abuse, regulatory/compliance issues, or violation of these Terms.
Payments are processed securely through third-party payment partners (e.g., UPI, cards, net banking, wallets). By submitting a payment method, you authorize us and our partners to charge the full order amount, including applicable taxes, shipping/handling (as shown at checkout), and adjustments disclosed at checkout. Refund timelines follow the relevant payment rails and our Returns & Refunds Policy (published separately). We are not responsible for delays attributable to banks/partners.

If you submit reviews, ratings, questions, images, or other content (User Content):
All Platform content (including text, images, logos, Ecoverify™ outputs, product badges, software, and designs) is protected by IP laws and owned by Ecoyaan or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Platform or content without our prior written consent.
Sellers must comply with applicable Indian laws, including without limitation the Consumer Protection (E-Commerce) Rules, 2020, Legal Metrology (Packaged Commodities) Rules, 2011, GST and tax regulations, FSSAI (for food and relevant personal care), IP and advertising laws. Buyers must not use the Platform to procure prohibited/restricted items or for unlawful purposes. We may cooperate with authorities and remove non-compliant listings.
Product information (including ingredients, allergens, sustainability attributes) is provided for general information only and may be supplied by sellers. It is not medical advice. Always read labels/instructions and consult a professional regarding allergies, medical conditions, or dietary needs.
The Platform may contain links to third-party sites or services (including logistics and payments). We are not responsible for their content, terms, or privacy practices. Your use of third-party services is at your own risk.
Except as expressly stated by us in writing, the Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Ecoyaan will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of the Platform. In any case, Ecoyaan’s aggregate liability for claims arising from or related to the Platform shall not exceed the greater of (a) ₹5,000 or (b) the total fees paid by you to Ecoyaan for the order giving rise to the claim. Nothing in these Terms excludes liability for fraud or negligence causing personal injury.
You agree to indemnify and hold harmless Ecoyaan, its directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to: your misuse of the Platform; violation of these Terms; violation of law or third-party rights; or User Content you submit.
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, strikes, labour disputes, war, terrorism, governmental actions, internet or utility failures, or carrier/logistics disruptions.
You consent to receive communications from us electronically (email, SMS, in-app, Platform notices) and agree that such communications satisfy legal requirements. We maintain electronic records consistent with applicable Indian law.
We may update these Terms from time to time. The “Effective date” above will change when updates are posted. Your continued use of the Platform after updates constitutes acceptance of the revised Terms."
We may assign our rights and obligations under these Terms. Failure to enforce any provision is not a waiver. If any provision is held invalid, the remainder remains in effect. These Terms, together with the policies referenced herein, constitute the entire agreement between you and Ecoyaan regarding the Platform and supersede prior or contemporaneous terms on the same subject.
These Terms are governed by the laws of India. The parties shall first attempt amicable resolution. If unresolved within a reasonable period, disputes shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, seated in Bengaluru, Karnataka. The language of arbitration shall be English. Subject to the foregoing, courts at Bengaluru shall have exclusive jurisdiction.
As required by applicable law, Ecoyaan has appointed a Grievance Officer.
